The crime against humanity of gender persecution is the intentional and severe deprivation of fundamental rights contrary to international law. This means prosecutors can and should highlight all fundamental rights violations that a perpetrator intentionally causes when committing a crime that may amount to gender persecution.

A suicide bomb attack kills dozens at a private education institution in Kabul that was attended by Hazaras and was one of the few available sites where girls could still attain education. Separately, a gay man is taken out of his house, beaten, and beheaded by Taliban members, who stated that this is what they do to LGBTQI+ persons to set an example. Taliban militants also shot and killed at least four women prisoners who had been detained on charges of “moral corruption.”
Taliban officers imprison, torture and rape three women protestors. When the women are released, they are warned that if they don’t stay silent, videos of the rapes will be publicized.
Taliban leaders subject a group of cisgender women and girls and trans men to forced marriage with Taliban fighters. Separately, the Taliban sexually humiliate a trans man at a checkpoint reportedly for being without a headscarf.
A paramilitary member burns a Black woman with a metal rod to “mark her as his property.” In another incident, paramilitary members kidnap a trans woman. They take her outside of town, forcibly cut her long hair, and subject her to torture for “dressing like a woman.”
Paramilitary members kill a woman human rights defender for her work promoting human rights for Black women in Magdalena. In another instance, paramilitariess kill a trans woman publicly, leaving her body in the street for the town to see.
Armed actors rape several women who belonged to Asociación de Mujeres Afrodescendientes por la Vida. The women had created the organization to protect their children from being recruited by armed actors. The men target them in part as a punishment for their role as activists. In another instance, armed actors rape a lesbian, stating that she was “too pretty to be with women” and that she “should be with men instead.”
Armed actors forcibly recruit an 11-year-old Indigenous girl and subject her to forced contraception. In another incident, commanders of an armed group force girls (within the group) to marry them. The commanders reportedly tell them, “You have to be with me and if not, you die.”
Russian soldiers capture two men they perceive as gay and detain them for several days. The soldiers subjected the men to abuse, torture and threats of rape. In another incident, Russian soldiers hold a woman captive. They electrocute her, photograph her naked and force her to hold her hands above her head for extended periods of time.
Russian forces formulate a list of those they plan to kill or send to camps, including members of vulnerable populations in Ukraine, specifically targeting LGBTQI+ persons among others. The list also includes journalists, activists, ethnic and religious minorities.
Russian commanders encourage troops to sexually assault Ukrainians as a “humiliation tactic” that forms part of a war strategy. In one instance, Russian soldiers rape twenty-five women and girls in the basement of a house. The Soldiers tell the victims they want to prevent them from having Ukrainian children. In another instance, Russian soldiers break into a house where a lesbian couple lived, and after finding out they were partners, rape both women.
ISIS fighters arrest a woman and her two daughters for attempting to flee an ISIS-controlled area following her husband’s death. Upon their capture, fighters forcibly marry her daughters and publicly execute the woman. In another incident, ISIS fighters kill three women for not wearing a veil in public. Separately, ISIS fighters execute two men accused of being gay by throwing them from a 3-story building.
ISIS fighters forcibly take a woman from her home for not wearing a veil and proceed to beat and rape her. In another instance, ISIS fighters arrest four women on charges of witchcraft (a charge they reportedly apply to women who resist forced marriage or transgress other imposed gender roles). The fighters detain, rape and later murder the women. In another instance, ISIS fighters rape three young men accused of sodomy. ISIS fighters then execute them.
ISIS publishes rules on the trade and sale of women and girls, justifying enslavement of them and detailing conditions under which they can be bought, sold, beaten and raped. A survivor of ISIS captivity recounts how men would come in the morning to buy girls, rape them and bring them back to exchange for new girls.
ISIS fighters visit households to collect information on the numbers of women per family, information which used to force women into marriages with ISIS fighters.
“Persecution” is the intentional and severe deprivation of fundamental rights contrary to international law because of a group’s identity or collectivity.
Perpetrators may commit torture to enforce discriminatory policies.
For example, women’s human rights defenders in Afghanistan have been tortured for demonstrating for women’s rights, including the rights to education and to work. These acts may constitute the deprivation of the fundamental right to freedom from torture as well as the fundamental rights to freedom of peaceful assembly, to education and to work. Taken together, such fundamental rights deprivations are severe and may amount to gender persecution. Gender persecution charges can hold criminally accountable perpetrators of torture and of violations of the rights to assembly, education and work.
Perpetrators may commit murder to enforce discriminatory gender policies.
For example, perpetrators may sentence to death women because they served as politicians or journalists, or victims perceived to be LGBTQI+ persons. These acts may constitute the deprivation of the fundamental right to freedom from murder as well as the fundamental rights to work and freedom of expression. Taken together, such fundamental rights deprivations are severe and may amount to gender persecution. Thus, gender persecution charges can hold murder and violations of the right to freedom of expression and the right to work.
Sexual violence is almost always committed with gender discrimination and may amount to gender persecution.
For example, perpetrators may target women and girls because they view them as “chattel” or “war booty” (based on the discriminatory belief that women are lesser than men and should be treated like property). At the same time, perpetrators may target men and boys through rape as a strategy to “feminise” them and/or to invoke the “indignity” of being treated as a woman or a “homosexual” (based on the belief that men enjoy a higher standing than women or LGBTQI+ persons). See ICC – OTP Gender Persecution Policy Paper, para. 51. These acts may constitute the deprivation of the fundamental right to freedom from sexual violence as well as the fundamental right to freedom from discrimination (that undergirds all persecution crimes). Thus, gender persecution charges can hold accountable perpetrators of sexual violence crimes and of violations of the right to be free from discrimination.
Criminal acts committed against children can be both crimes against humanity and human rights violations that may amount to gender persecution.
For example, the crime of bombing a girls’ school in furtherance of a prohibition on girls’ education may amount to a severe deprivation of the fundamental right to life and the right to education. Taken together, such fundamental rights deprivations are severe and may amount to gender persecution. Thus, gender persecution charges can hold crimes against children and violations of the right to education.
Inhumane acts that amount to crimes against humanity are also human rights violations and may amount to gender persecution.
For example, perpetrators who beat women for being in public without a male guardian violate the fundamental right to freedom of movement, as well as the right to be free from inhumane treatment. Taken together, such fundamental rights deprivations are severe and may amount to gender persecution. Thus, gender persecution charges can hold inhumane acts and violations of the right to freedom of movement.
